RAND Issues Preliminary MLFS Report; Big Changes Coming

Yesterday, RAND Corporation presented to the Commission on Health and Safety and Workers' Compensation (CHSWC) its preliminary findings and possible changes to the Medical-Legal Fee Schedule. As we expected, the tenor of the one-hour slide presentation portends wholesale revisions to the fee schedule that has been in place since 1993. The changes will impact QMEs, AMEs and even PTPs.

Although the Commissioners received advance copies of the report, it was not made available to the public. However, RAND researcher Barbara Wynn, mentioned after the meeting that she anticipated the report will be available soon. 
CSIMS expects to obtain a copy of the report shortly and will make it a major topic of discussion at the upcoming Mid-Summer Seminar at Squaw Creek, June 8-10.

In their presentation, RAND researchers mentioned that the current MLFS is flawed; sometimes shortchanging physicians but also encouraging gaming by others. They believe the forensic process can be streamlined to provide better value to the parties. Complexity factors may be revised because of the frequent disputes over their applicability in certain cases. They may also be considering a different hourly rate for records review than what is paid for the rest of the evaluation. All issues remain on the table and it remains highly likely that there will be a significant paradigm shift when the revised fee schedule emerges later this year.

DWC Executive Medical Director Ray Meister, M.D., and DWC Counsel Winslow West, Esq., will be at the CSIMS Mid-Summer Seminar and will have an opportunity to express their views on the fee schedule. 

The CSIMS Medical-Legal Fee Schedule Task Force intends to play a major role in the evolution of the new schedule.
